Unreel Adventures – Day Tour Terms & Conditions

Effective July 2026

These Terms & Conditions apply to day tours and half-day tours operated by Unreel Adventures, a trading name of Hartley Motorcycles Pty Ltd ATF the Hartley Family Trust.

By making a booking, paying any deposit or balance, or participating in a tour, each guest accepts these Terms & Conditions.

1. Bookings and Payment

A booking is secured upon receipt of a 20% deposit, unless otherwise agreed in writing.

The balance is due before departure at the time advised by Unreel Adventures. Bookings made close to departure may require full payment at the time of booking.

2. Guest Cancellation

All cancellations must be notified to Unreel Adventures as soon as possible.

For cancellations made more than 72 hours before departure, any refund will be determined according to the circumstances and any non-recoverable costs already incurred.

For cancellations made within 72 hours of departure, failure to arrive, or late arrival resulting in a missed departure, no refund is payable, except where required by law.

Guests are strongly advised to obtain suitable travel insurance.

3. Weather, Tides and Itinerary Changes

Tours operate in a dynamic Kimberley marine environment and are subject to tides, weather, sea conditions and other operational considerations.

Unreel Adventures may reasonably alter departure times, return times, routes, destinations and activities where necessary for safety or operational reasons.

The Master of the vessel has final authority over navigation, safety and operational decisions.

4. Cancellation Outside Our Control

A tour may be cancelled, delayed or changed due to circumstances outside the reasonable control of Unreel Adventures, including severe weather, unsafe sea conditions, flooding, natural disasters, government restrictions, closure of waterways or other unforeseen events.

Any entitlement to a refund, credit or other remedy will be determined according to the circumstances, these Terms & Conditions and applicable law.

Unreel Adventures is not responsible for consequential costs such as accommodation, flights or other travel arrangements, except where required by law.

5. Operational Changes and Disruption

Unreel Adventures may make reasonable changes to operations, itinerary, activities, equipment, tender arrangements, staffing or catering where necessary for safety or operational reasons.

The breakdown or unavailability of particular equipment, tender vessels, activities, crew or services does not of itself entitle a guest to a refund where the tour can continue and reasonable alternative arrangements are made.

Any entitlement to a refund, compensation or other remedy will be determined according to the circumstances and the Australian Consumer Law.

6. Medical Fitness and Safety

Guests must be reasonably fit and capable of participating safely in the tour and must disclose any medical condition, mobility limitation, allergy or other circumstance that may reasonably affect their safety or participation.

Guests must follow all lawful and reasonable safety instructions given by the Master and crew.

7. Remote Area Risks

Guests acknowledge that tours may operate in remote areas where medical assistance, communications and emergency response may be limited or delayed.

Guests accept the inherent risks associated with remote marine travel, fishing, boating, wildlife and natural environments, subject to rights that cannot lawfully be excluded.

8. Guest Conduct

Guests must behave responsibly and must not endanger themselves, other guests, crew, vessels or property.

Unreel Adventures may restrict or terminate participation where a guest engages in dangerous, abusive, unlawful or seriously disruptive conduct, or refuses to follow reasonable safety instructions.

9. Fishing, Crabbing and Wildlife

All fishing and crabbing activities are subject to applicable laws, licences, size limits, possession limits, seasonal restrictions and environmental requirements.

No particular catch, species, quantity of catch or wildlife sighting is guaranteed.

10. Personal Belongings

Guests are responsible for their own valuables, electronic equipment and personal belongings.

Unreel Adventures is not responsible for loss or damage except to the extent liability cannot lawfully be excluded.

11. Australian Consumer Law

These Terms & Conditions operate subject to the Australian Consumer Law.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

12. Governing Law

These Terms & Conditions are governed by the laws of Western Australia.

13. Acceptance of Terms

By making a booking, paying any deposit or balance, submitting a booking or confirmation form, or participating in a tour, the guest acknowledges that they have read, understood and accepted these Terms & Conditions.
