Unreel Adventures – Kimberley Charter Terms & Conditions

Effective July 2026

These Terms & Conditions apply to multi-day voyages, extended charters and Kimberley marine adventures operated by Unreel Adventures, a trading name of Hartley Motorcycles Pty Ltd ATF the Hartley Family Trust.

By making a booking, paying a deposit or balance, or participating in a charter, each guest acknowledges and accepts these Terms & Conditions.

1. Bookings and Deposit

A booking is secured upon receipt of a 20% deposit, unless otherwise agreed in writing.

The deposit confirms the guest’s intention to travel and reserves the agreed charter dates and available places.

Bookings are subject to availability and are not confirmed until accepted by Unreel Adventures.

2. Final Payment

The balance of the charter price is due 60 days before departure, unless otherwise agreed in writing.

Where a booking is made within 60 days of departure, full payment may be required at the time of booking.

Failure to pay the balance by the due date may be treated as cancellation by the guest.

3. Guest Cancellation

All cancellations must be notified to Unreel Adventures in writing.

Unless otherwise agreed in writing:

  • More than 90 days before departure: payments made may be refunded less the deposit and any non-recoverable costs already incurred specifically for the booking.
  • Within 90 days of departure: 100% of the charter price is forfeited.
  • Failure to arrive for departure, late arrival resulting in a missed departure, or voluntary withdrawal after the charter has commenced: 100% of the charter price is forfeited.

Unreel Adventures strongly recommends comprehensive travel insurance covering cancellation, illness, injury, emergency evacuation, travel disruption and other unforeseen circumstances.

4. Travel Insurance

Guests are strongly advised to obtain comprehensive travel insurance at the time of booking.

Insurance should, where appropriate, cover:

  • cancellation and interruption;
  • illness or injury;
  • emergency medical treatment;
  • emergency evacuation and repatriation;
  • missed connections and travel delays;
  • lost or damaged baggage and personal belongings; and
  • other unforeseen circumstances affecting travel.

Guests are responsible for ensuring that their insurance is suitable for remote marine travel and their individual circumstances.

5. Changes to Itinerary

The Kimberley is a remote and dynamic marine environment.

Routes, destinations, departure times, return times, anchorages and activities may be changed due to:

  • tides and tidal currents;
  • weather and sea conditions;
  • river and creek conditions;
  • navigation considerations;
  • safety requirements;
  • availability of suitable anchorages;
  • mechanical or operational considerations;
  • government or regulatory directions; or
  • other circumstances affecting the safe and practical conduct of the voyage.

Published itineraries are indicative only and do not constitute a guarantee that every location or activity will be available.

The Master of the vessel has final authority over navigation, safety, itinerary and operational decisions.

6. Cancellation or Disruption Outside Unreel Adventures’ Control

Unreel Adventures may be unable to commence, continue or complete a voyage due to circumstances outside its reasonable control, including but not limited to:

  • cyclones;
  • severe weather;
  • unsafe sea conditions;
  • flooding;
  • bushfire;
  • natural disaster;
  • epidemic or pandemic;
  • government restrictions or directions;
  • closure of ports, waterways or access areas;
  • war;
  • terrorism;
  • civil unrest;
  • industrial action;
  • failure or disruption of essential services;
  • actions of third parties; or
  • other events beyond the reasonable control of Unreel Adventures.

Where a voyage is cancelled, delayed, shortened or materially affected by such circumstances, no refund is payable except where required by applicable law.

Unreel Adventures is not responsible for consequential costs incurred by guests, including flights, accommodation, alternative travel arrangements or other associated expenses.

Guests should maintain appropriate travel insurance for these risks.

7. Operational Changes and Disruption

Unreel Adventures may make reasonable changes to operations, itinerary, activities, equipment, tender arrangements, staffing or catering where necessary for safety or operational reasons.

The breakdown or unavailability of particular equipment, tender vessels, activities, crew or services does not of itself entitle a guest to a refund where the voyage can continue and reasonable alternative arrangements are made.

Any entitlement to a refund, compensation or other remedy will be determined according to the circumstances and the Australian Consumer Law.

8. Mechanical Failure and Remote Operations

Guests acknowledge that Unreel Adventures operates vessels and equipment in remote areas where immediate repair facilities, spare parts and technical support may not be available.

Reasonable changes to itinerary, timing or activities arising from minor equipment issues, maintenance requirements or prudent operational decisions do not automatically entitle a guest to a refund.

Where a significant mechanical failure within Unreel Adventures’ reasonable control results in cancellation or material shortening of the voyage, Clause 7 applies.

9. Medical Fitness and Disclosure

Guests must be physically and medically capable of participating safely in the voyage and proposed activities.

Guests must disclose before departure any medical condition, mobility limitation, allergy, medication requirement or other circumstance that may reasonably affect:

  • their own safety;
  • the safety of other guests or crew;
  • emergency response requirements; or
  • their ability to participate in the voyage.

Guests must carry sufficient quantities of all required personal medications.

Unreel Adventures reserves the right to decline or restrict participation where reasonably necessary for safety.

10. Remote Area Risks

Guests acknowledge that Kimberley voyages operate in remote and isolated areas where:

  • medical facilities may be distant;
  • emergency response may be delayed;
  • evacuation may be difficult or expensive;
  • mobile telephone coverage may be limited or unavailable;
  • weather and sea conditions may change rapidly;
  • wildlife and natural hazards may be encountered; and
  • normal urban services may not be available.

Guests accept the inherent risks associated with remote marine travel, subject always to rights that cannot lawfully be excluded.

11. Safety and Master’s Authority

All guests must comply with:

  • lawful directions of the Master and crew;
  • vessel safety procedures;
  • emergency instructions;
  • restrictions relating to dangerous or unsafe conduct; and
  • reasonable requirements necessary for the safety and welfare of all persons aboard.

The Master may restrict a guest’s participation in an activity or take other reasonable action where necessary for safety.

12. Guest Conduct

Guests must behave responsibly and must not endanger themselves, other guests, crew, the vessel or property.

Unreel Adventures may take reasonable action in response to:

  • violent, abusive or threatening behaviour;
  • serious intoxication;
  • unlawful conduct;
  • repeated refusal to follow safety instructions; or
  • conduct that materially disrupts the voyage or endangers others.

Where a guest’s participation is terminated because of serious misconduct, no refund will be payable except where required by law.

13. Alcohol and Drugs

Alcohol consumption must be responsible and must not compromise safety.

Illegal drugs are prohibited.

The Master may restrict alcohol consumption or participation in activities where reasonably necessary for safety.

14. Personal Belongings

Guests are responsible for their own luggage, valuables, electronic equipment and personal belongings.

Unreel Adventures is not responsible for loss or damage except to the extent liability cannot lawfully be excluded.

Guests should ensure that appropriate travel insurance covers personal property.

15. Contagious Illness

Guests must not knowingly join a voyage while suffering from a contagious illness that may create a material risk to other guests or crew.

Guests must disclose relevant circumstances where reasonably necessary for health and safety.

Unreel Adventures may take reasonable measures to protect guests and crew, including restricting participation where necessary.

16. Fishing, Wildlife and Environmental Compliance

All fishing and wildlife activities are subject to applicable laws, licences, seasonal restrictions, possession limits and directions of relevant authorities.

No particular catch, species, fishing result or wildlife sighting is guaranteed.

Guests must comply with all lawful instructions relating to fishing, wildlife and environmental protection.

17. Photography and Media

Unreel Adventures may take photographs or video during voyages for operational, promotional or marketing purposes.

Guests who do not wish to appear in promotional material should advise Unreel Adventures before or during the voyage.

18. Limitation of Liability

To the maximum extent permitted by law, Unreel Adventures is not liable for loss, damage, delay, inconvenience or additional expense arising from circumstances outside its reasonable control.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law where such right or remedy cannot lawfully be excluded, restricted or modified.

19. Australian Consumer Law

These Terms & Conditions operate subject to the Australian Consumer Law.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any statutory consumer right, guarantee or remedy that cannot lawfully be excluded, restricted or modified.

20. Governing Law

These Terms & Conditions are governed by the laws of Western Australia.

The parties submit to the jurisdiction of the courts and tribunals of Western Australia.

21. Acceptance of Terms

By making a booking, paying any deposit or balance, submitting a Charter Confirmation Form, or participating in a voyage, the guest acknowledges that they have read, understood and accepted these Terms & Conditions.
